Official Rules for the “Mid-America Piano 30^th Anniversary Giveaway” Sweepstakes

OFFICIAL RULES:

NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE, CONTRIBUTION, DONATION, OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

ELIGIBILITY: The “Mid-America Piano 30^th Anniversary Giveaway” Sweepstakes (“Sweepstakes”) is open only to legal residents of the fifty (50) United States of America and the District of Columbia (excluding Rhode Island). Void in Puerto Rico, outside the United States of America, and where prohibited by law. Must be 18 or older at the time of entry. Employees of Mid-America Piano, LLC (“Sponsor”), and its parent, subsidiaries, limited liability and affiliated companies, and advertising and promotion agencies, and each of their respective family members (parent, child, spouse, sibling and their respective spouses, regardless of where they reside), and members of their households, whether or not related, are not eligible to enter or win. Sweepstakes is subject to all applicable federal, state and local laws. Void where prohibited by law.

Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

SWEEPSTAKES PERIOD: The “Mid-America Piano 30^th Anniversary Giveaway” Sweepstakes begins on  AUGUST 18, 2016 AT 9:01 A.M. CENTRAL STANDARD TIME (“CST”) and ends on SEPTEMBER 10, 2016 at 3:59 p.m. CST (the “Sweepstakes Period”).

HOW TO ENTER: During the Sweepstakes Period, there are five (5) ways to enter (all free), twenty-four (24) Entry Periods, and twenty-seven (27) prizes available to be won from August 18, 2016 9:01 a.m. CST to September 10, 2016 3:59 p.m. CST (see chart: “Entry Periods & Drawing Schedule” herein for Entry Period and drawing dates and times as well as prize details). Entries must be received during the applicable Entry Period as indicated in the aforementioned chart to be eligible for that Entry Period’s drawing.

FIVE WAYS TO ENTER (ALL FREE):

               For a single chance:
1. Complete the online entry at www.piano4u.com/specials; OR
2. Send an email with the subject line “Giveaway Entry” to piano@piano4u.com and include the following: Name, Address, Phone Number, Email Address, and Date of Birth; OR
3. Mail the following information to “Mid-America Piano 30^th Anniversary Giveaway” Sweepstakes c/o Mid-America Piano, LLC, 241 Johnson Rd., Manhattan, KS 66502; OR

               To triple your chance:
4. During business hours (Monday-Saturday, 9am-5:30pm CST; Closed 9/5/16), complete a paper entry form at Mid-America Piano, 241 Johnson Rd., Manhattan, KS 66502; OR
5. During business hours (Monday-Saturday, 9am-5:30pm CST; Closed 9/5/16), call toll free 1-800-950-3774 and provide the following: Name, Address, Phone Number, Email Address, and Date of Birth

Limit one (1) entry per person, per day of the Entry Period. If both a single and a triple chance entry are completed in the same day by the same person, the triple chance entry will be counted as valid and the single chance will be void. Entries received from any person in excess of the limitation will be void. Entries generated by script, macro or other automated or mechanical means, or by any means which subvert the entry process will be void. All entries become the sole property of the Sponsor and will not be returned.  Released Parties (as defined below) are not responsible for lost, late, stolen, garbled, incomplete, damaged, delayed, illegible, mutilated, misdirected, or postage-due entries or mail.  Incomplete, illegible, or fraudulent entries will be void.  By entering the Sweepstakes, you are providing your information to Sponsor.

DRAWING: Potential winners will be selected in computer-generated random drawings or randomly from paper entries from among all eligible entries received during the applicable Entry Period (see “Entry Periods & Drawing Schedule” herein for Entry Periods and drawing dates and times).  Potential winners do not need to be present to win. Odds of winning depend on the number of eligible entries received. Entrants not picked as prize winners will be rolled over to the next Entry Period until the conclusion of the Sweepstakes. Entrants picked as winners of the $10 gift card of their choice from either iTunes, Coldstone Creamery, or Panera Bread prize will be rolled over to the next Entry Periods until the conclusion of the Sweepstakes. Entrants picked as winners of the Console Piano, Metronome, Piano Lamp, GoPro Camera, TV, and iPad prizes will not be rolled over to any of the next Entry Periods.

WINNER NOTIFICATION: Potential winner(s) will be contacted via phone and/or email on or about one (1) business day after each drawing. Potential winner(s) will be required to respond to that email and/or phone call within 72 hours of email and/or phone notification or prize will be forfeited and awarded to an alternate winner. Prize winners may be required to execute and return an affidavit of eligibility, a publicity release (except where prohibited), a liability release, and/or a copy of his/her valid personal identification card bearing his/her photograph, name, age, and address within seven (7) days of date of issuance.  The execution of additional releases and/or waivers of liability required by Sponsor and/or any other applicable sanctioning body or prize provider may also be required and returned within the time period specified by such entities, as appropriate.  Return of prize or prize notification as undeliverable, failure to sign and return requested documentation within the specified time period, the inability of Sponsor to contact a potential winner within a reasonable time period or noncompliance with these Official Rules by any potential winner will result in disqualification and, at Sponsor’s sole discretion, the prize may be awarded to an alternate winner. If any potential winner is at least 18 but still considered a minor in his/her jurisdiction of residence, Sponsor reserves the right to award the prize in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winners set forth herein.

PUBLICITY: Acceptance of any prize constitutes permission to use winner’s name, biographical information, city and state of residence, voice, photograph, image and/or likeness for advertising, promotional and other purposes in any and all media now known or hereafter devised, worldwide, in perpetuity, without further compensation, notification or permission from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so, unless prohibited by law.

PRIZES: All applicable federal, state and local taxes, any other expenses associated with prize acceptance and use not specifically listed herein as being provided including, but not limited to, shipping and delivery charges are the responsibility of each winner. No substitution or cash redemption allowed except at discretion of the Sponsor. Prize is not transferable. Sponsor reserves the right to substitute a prize with a prize of equal or greater value, if the advertised prize becomes unavailable. Prizes are awarded “as is,” “where is” with no warranty or guarantee, either express or implied by Sponsor. Total Approximate Retail Value (ARV) of all prizes is: $4,899.00. All prize details are at Sponsor’s sole discretion.

GENERAL CONDITIONS: By entering this Sweepstakes and/or accepting any prize, entrant agrees: (1) to release, discharge and hold harmless Sponsor, their respective parent, subsidiaries, limited liability and affiliated companies, advertising and promotion agencies, and each of their respective shareholders, officers, directors, employees, members, agents and assigns (collectively, the “Released Parties”) from liability of any kind or nature for any loss, claims, damages, or injuries of any kind resulting in whole or in part, directly or indirectly from entrant’s participation in this Sweepstakes or from the acceptance and use/misuse of any prize; and (2) to abide by, and be bound by these Official Rules and the decisions of the Sponsor relating to participation in the Sweepstakes, selection of winners and awarding of prizes, which shall be final. Released Parties are not responsible for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prize[s], or in any Sweepstakes-related materials.  Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes.  Released Parties are not responsible for injury or damage to any person’s computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website.  Persons who tamper with or abuse any aspect of the Sweepstakes or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, or should the Sweepstakes be unable to run as planned for any other reason, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes and, if terminated, at its discretion, select the potential winner[s] in a random drawing from among all eligible, non-suspect entries received prior to action taken. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

ARBITRATION: By participating, entrant agrees as follows: that good faith efforts will be used to attempt to resolve any and all claims and disputes arising under or relating to the Sweepstakes. Any dispute, controversy or claim relating to the Sweepstakes, including but not limited to the interpretation thereof, the awarding or redemption of prizes, or the determination of the scope, enforceability or applicability of this agreement to arbitrate, which cannot be resolved amicably, shall be referred to arbitration before the American Arbitration Association, which shall be the sole and exclusive forum for resolution and settlement of any dispute, controversy or claim between the parties. Any and all legal action, suit, arbitration, or other proceeding with respect to the Sweepstakes will be resolved individually, without respect to any form of class or representative action.

FORUM SELECTION: This Sweepstakes shall be governed by the laws of the State of Kansas. Each entrant knowingly and voluntarily intends and agrees that (i) the mandatory, exclusive venue for any action in any way related to or arising out of this Sweepstakes or prizes awarded shall be resolved individually without resort to any form of class action and shall be the state and federal courts in and for Riley County, Kansas; and (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering any Sweepstakes, but in no event attorneys’ fees. Each entrant hereby knowingly and voluntarily waives any and all objections to venue and personal jurisdiction in the foregoing, and submit themselves thereto. Each entrant hereby waives any right it may have to assert the doctrine of forum non conveniens or similar doctrine or to object to venue with respect to any proceeding brought in accordance with this paragraph, and stipulates that the aforementioned courts shall have in personam jurisdiction and venue over them for the purpose of litigating any dispute, controversy, or proceeding arising out of or related to this Sweepstakes.

WINNERS’ LIST: The winners’ names will be posted at https://pianonotes.wpengine.com/index.php/2016/07/mid-america-piano-30th-anniversary-giveaway-winners-list/ and they may be obtained by sending a properly stamped, self-addressed envelope to the “Mid-America Piano 30^th Anniversary Giveaway” Sweepstakes c/o Mid-America Piano, LLC, 241 Johnson Rd., Manhattan, KS 66502.  Mail-in winners’ list requests must be postmarked by March 31, 2017 or they may not be honored.

Each winner’s name may be posted on the official webpage.

When you enter into this Sweepstakes, we collect personally identifying information about you, including your name, complete mailing address, and email address. The information that you provide will be added to Sponsor’s database. By providing the required entry information, you acknowledge that Sponsor may send you information, samples, or special offers it believes may be of interest to you.
